Welcome to EdCalibre! EdCalibre is a dedicated platform designed to provide comprehensive
math practice for students and children in grades 6 to 10. Our mission is to enhance students’
math skills through interactive and personalized learning experiences.


These Terms and Conditions (“Agreement”) constitute a legally binding agreement between
you (“User,” “you,” or “your”) and EdCalibre Private Limited (“EdCalibre,” “we,” “us,” or “our”).
By accessing or using our website https://edcalibre.com/, mobile application, or any other
services provided by EdCalibre (collectively, the “Platform”), you agree to comply with and be
bound by the terms and conditions set forth in this Agreement. If you do not agree to these
terms, you must not access or use our Services.


EdCalibre reserves the right to modify, update, or change these Terms and Conditions at any
time. Any changes will be effective immediately upon posting on our website. It is your
responsibility to review these terms periodically to stay informed about any updates. Continued
use of our Services after any such changes constitutes your acceptance of the new terms.


By accessing or using our Services, you acknowledge that you have read, understood, and
agree to be bound by this Agreement and our Privacy Policy. If you are under the age of 18
years, you must have your parent or legal guardian’s permission to use our Services. Parents or
legal guardians of users under the age of 18 years must read and agree to these terms on
behalf of the minor user.


For the purposes of these Terms:


• “User” refers to any individual who accesses or uses the Services provided by
EdCalibre, including but not limited to the guardian/parent or the child (under the
supervision of their parent).
• “Services” refers to the website, mobile application, and any other services provided by
EdCalibre, including but not limited to the math practice application for students in
grades 6 to 10.
• “Content” refers to all materials, including but not limited to text, images, graphics,
software, and other digital content provided through the Services.


By using our Services, you acknowledge that you have read, understood, and agreed to be
bound by this Agreement. If you do not agree to these terms, you must not use our Services.


GENERAL


• Our Services are catered to Users in the age group of 12 years to 16 years.
Accounts for our Services must be created by the parents or legal guardians on
behalf of their children or by authorized representatives of EdCalibre. By creating
an account, parents or guardians represent and warrant that they have the legal
authority to act on behalf of the child user and agree to the terms of this
Agreement on the child’s behalf.


• You agree to use our Services only for lawful purposes and in accordance with
this Agreement. You agree not to:


• Violate any applicable local, state, national, or international law or
regulation.
• Infringe upon or violate our intellectual property rights or the intellectual
property rights of others.
• Use our Services to transmit or distribute any unsolicited or unauthorized
advertising, promotional materials, or spam.
• Engage in any activity that could damage, disable, overburden, or impair
the functioning of our Services.
• Attempt to gain unauthorized access to our systems or networks or to any
other user’s account.


• Any accessing, browsing, or otherwise using the Platforms indicates your
agreement to these Terms and Conditions, the Privacy Policy, and the Refund
Policy of the Platform and any other policies or guidelines that may be applicable
to your usage of the Platform at the time of your access and usage of the
Platform and which may be updated from time to time.


• This document is an electronic record coming under the purview of The India
Digital Personal Data Protection Act 2023 (DPDPA) and the Information
Technology Act, 2000 and individual state legislation in each state and territory of
India, and rules made thereunder as may be applicable, and the amended
provisions pertaining to electronic records in various statutes as amended by the
Indian legislature. This electronic record is generated by a computer system and
does not require any physical or digital signatures and your usage of the Platform
or the Services and/or purchasing of the Products deems your acceptance of the
terms of this Agreement.


• We authorize you to view and access the Platform solely for identifying our
Services, carrying out purchases of our Services and processing returns and
refunds. Therefore, we grant you a limited, revocable permission to access and
use the Platform provided by us.


• We may, from time to time, and at our sole discretion, offer promotions, being
exclusive in nature and for a limited period of time, for promoting some of our
Services on the Platforms, and during such promotions, we may offer lowered
prices for the Services. However, such prices may be changed and/or altered as
per our convenience. We may, from time to time, and at our sole discretion, also
organize contests and sweepstakes on the Platform and such contests and/or
sweepstakes shall have rules and regulations as decided and/or made applicable
by us.


REGISTRATION OF YOUR ACCOUNT


• To access certain features of our Services, an account must be created by a
parent, legal guardian, or an authorized representative of EdCalibre on behalf of
the child user. By creating an account, the parent or guardian represents and
warrants that they have the legal authority to act on behalf of the child user and
agree to the terms of this Agreement on the child’s behalf.


• When registering for an account, you agree to:


• Ensure that all information provided during the registration process is
accurate, current, and complete. This includes providing the full name,
email address, phone number, grade, age, and country of residence.
• Promptly update your account information to keep it accurate, current,
and complete.


• You are responsible for maintaining the confidentiality of your account login
information and for all activities that occur under your account. You agree to:


• Keep your account username and password secure and confidential.
• Notify us immediately at info@edcalibremath.com if you become aware of
any unauthorized use of your account or any other breach of security.
• Accept responsibility for all activities that occur under your account,
whether or not you authorized the activity.


• Parents or legal guardians creating an account on behalf of a child user agree to:


• Supervise and monitor the child’s use of the Services to ensure
compliance with this Agreement.
• Read and agree to these Terms and Conditions on behalf of the child
user.
• Provide verifiable consent for the collection, use, and disclosure of
personal information about the child as outlined in our Privacy Policy.


• In cases where an authorized representative of EdCalibre creates an account on
behalf of a child user, the representative agrees to:


• Ensure that the creation and management of the account comply with
EdCalibre’s internal policies and procedures.
• Keep all account information secure and confidential.
• Ensure that all actions taken on behalf of the child user are in the best
interest of the child and comply with applicable laws and regulations.


• EdCalibre reserves the right to terminate or suspend your account at any time,
without notice, for conduct that we believe violates this Agreement, is harmful to
other users of the Services, us, or third parties, or for any other reason. Upon
termination, all rights granted to you under this Agreement will immediately
cease.


• If your account has been terminated or suspended and you believe this was done
in error, you may contact our support team at info@edcalibremath.com to request
reactivation. Reactivation of the account will be at our sole discretion and may
require additional verification and compliance with our terms and policies.


USER CONDUCT


• By accessing or using EdCalibre’s Services, you agree to comply with all
applicable laws and regulations and to adhere to the terms of this Agreement.
You are responsible for all activities conducted through your account and must
ensure that you and anyone using your account abide by the following rules of
conduct.


• You agree not to engage in any of the following prohibited activities:


• Using the Services for any illegal or unauthorized purpose, or in violation
of any local, state, national, or international law or regulation.
• Copying, reproducing, distributing, modifying, creating derivative works
from, or otherwise infringing on the intellectual property rights of
EdCalibre or any third party.
• Attempting to gain unauthorized access to the Services, other user
accounts, or computer systems or networks connected to the Services
through hacking, password mining, or any other means.
• Interfering with or disrupting the integrity or performance of the Services
or the data contained therein. This includes transmitting any viruses,
worms, defects, Trojan horses, or other destructive items.
• Impersonating any person or entity, or falsely stating or otherwise
misrepresenting your affiliation with a person or entity.
• Engaging in any harassing, threatening, intimidating, predatory, or
stalking behavior, or inciting others to engage in such behavior.
• Using any robot, spider, scraper, or other automated means to access the
Services for any purpose without our express written permission.
• Using the Services for any commercial purpose or for the benefit of any
third party, except as expressly permitted by this Agreement or with our
prior written consent.
• Uploading, posting, transmitting, sharing, storing, or otherwise making
available any content that is unlawful, harmful, threatening, abusive,
defamatory, obscene, invasive of another’s privacy, or otherwise
objectionable.


• You are solely responsible for any content that you upload, post, transmit, or
otherwise make available through the Services. By providing any content to the
Services, you represent and warrant that you have the legal right to do so and
that such content does not violate any laws or infringe upon the rights of any third
party.


• EdCalibre reserves the right, but is not obligated, to:


• Monitor and review user activity and content for compliance with this
Agreement.
• Investigate any reported or suspected violations of this Agreement and
take appropriate action.
• Remove or disable access to any content that we determine, in our sole
discretion, violates this Agreement or is otherwise objectionable.
• Suspend or terminate the accounts of Users who violate this Agreement
or engage in any prohibited activities.


• If you become aware of any violation of this Agreement, you are encouraged to
report it to us immediately. You can contact our support team at
info@edcalibremath.com to report any such activities.


• Violations of this User Conduct clause may result in a range of actions, including
but not limited to:


• Issuing a warning to the User.
• Temporarily suspending the User’s account.
• Permanently terminating the User’s account.
• Taking appropriate legal action, including referral to law enforcement
authorities.


• SUBSCRIPTION AND PAYMENT


• EdCalibre offers a variety of subscription plans to cater to the needs of our Users.
Our primary subscription plan includes a free trial period followed by a paid
annual subscription. The details of our subscription plans, including pricing and
features, are available on our website at https://edcalibre.com/buy-now/.


Free Trial


• Users may sign up for a free trial period to evaluate our Services. The
duration of the free trial shall be specified on our website.
• The free trial is available to new Users only and may be used once per
User.
• At the end of the free trial period, Users will have the option to subscribe
to our paid annual plan. If the user does not subscribe, access to the
Services shall be terminated after the expiry of the free trial period.


Paid Subscription


• The paid subscription plan costs Eight Thousand Nine Hundred Ninety
Nine (8999) INR annually.
• The subscription does not renew automatically. Users must manually
renew their subscription each year to continue accessing the Services.
• We accept various payment methods, including credit cards, debit cards,
and other payment instruments. Payment details must be provided at the
time of subscription.
• All payments are processed securely through our third-party payment
processor. By providing payment information, you authorize us to charge
the specified amount to your payment method.


Financial Information


• To process subscription payments, we collect financial information,
including:


• Bank account details required for processing payments.
• Information such as credit card or debit card details needed to
complete transactions.
• Any other information necessary to process payments, ensuring
secure transactions.


• Refund requests must be made within fourteen (14) days of the subscription
payment date. Requests made after this period may not be eligible for a refund.

Subscription Management


• Users must manually renew their subscription each year. Notifications
regarding the renewal process shall be sent to the registered email
address before the subscription expiration date.
• Users can cancel their subscription at any time by contacting our support
team at info@edcalibremath.com. Cancellation shall be effective at the
end of the current subscription period, and no refunds shall be issued for
the remaining period.
• Failure to renew the subscription or provide valid payment information
may result in the suspension of the User’s account.


• All fees are exclusive of applicable taxes, levies, or duties imposed by taxing
authorities. Users are responsible for paying any such taxes, levies, or duties
applicable to their use of the Services.


• EdCalibre reserves the right to change the subscription plans, including the fees,
at any time. Any changes will be communicated to Users in advance, and the
new rates will apply at the time of subscription renewal. Users who do not agree
with the changes may cancel their subscription before the renewal date.


PRIVACY AND DATA PROTECTION


• At EdCalibre, we are committed to protecting your privacy and ensuring the
security of your personal information. We collect and use personal information to
provide and improve our Services, including creating and managing user
accounts, sending reports and newsletters, and processing subscription
payments.


• We adhere to strict data protection practices, including data encryption, secure
access controls, and regular security assessments, to safeguard your information
from unauthorized access, disclosure, alteration, or destruction. Parents or legal
guardians must provide verifiable consent for the collection, use, and disclosure
of personal information for Users under the age of 16 years.

INTELLECTUAL PROPERTY


• All content, materials, and services provided by EdCalibre, including but not
limited to the website, mobile application, text, images, graphics, software, audio,
video, designs, and other digital content (collectively, “Content”), are the property
of EdCalibre Private Limited and are protected by intellectual property laws,
including copyright, trademark, patent, and trade secret laws. All rights, title, and
interest in and to the Content remain with EdCalibre and its licensors.


• Subject to your compliance with these Agreement, EdCalibre grants you a
limited, non-exclusive, non-transferable, revocable license to access and use the
Services for your personal, and non-commercial use. This license does not
include any resale or commercial use of the Services or Content, or any
derivative use of the Services or Content.


• You agree not to:


• Copy, reproduce, distribute, publish, display, perform, modify, create
derivative works from, transmit, or otherwise exploit any part of the
Services or Content without the prior written consent of EdCalibre.
• Reverse engineer, decompile, or disassemble any part of the Services or
Content, except where such activity is expressly permitted by applicable
law.
• Remove, alter, or obscure any copyright, trademark, or other proprietary
notices contained in or displayed on the Services or Content.
• Attempt to gain unauthorized access to the Services or Content, or any
part thereof, or any systems or networks connected to the Services, by
hacking, password mining, or any other means.


• If you submit, upload, or post any content to our Services, including but not
limited to feedback, comments, suggestions, or other materials
(“User-Generated Content”), you grant EdCalibre a worldwide, perpetual,
irrevocable, royalty-free, transferable, sub-licensable license to use, reproduce,
distribute, prepare derivative works of, display, and perform such User-Generated
Content in connection with the Services and EdCalibre’s business, including
without limitation for promoting and redistributing part or all of the Services in any
media formats and through any media channels. You represent and warrant that
you have the necessary rights to grant this license and that your User-Generated
Content does not infringe or violate the rights of any third party.


• All trademarks, service marks, logos, trade names, and trade dress (collectively,
“Trademarks”) displayed on the Services are the property of EdCalibre or their
respective owners. You are not permitted to use any Trademarks without the prior
written consent of EdCalibre or the respective owner of the Trademark.


• If you believe that any content on our Services infringes your intellectual property
rights, please notify us immediately at info@edcalibremath.com. Your notification
should include:


• A description of the intellectual property that you claim has been infringed
and a description of the infringing content.
• Your name, address, telephone number, and email address.
• A statement that you have a good faith belief that the disputed use is not
authorized by the intellectual property owner, its agent, or the law.
• A declaration that the information in your notification is accurate and that
you are the intellectual property owner or authorized to act on the owner’s
behalf.


• EdCalibre reserves all rights not expressly granted to you in this Agreement. The
use of the Services and Content by you is permitted only as expressly set forth in
this Agreement. Any use of the Services or Content other than as specifically
authorized herein, without the prior written permission of EdCalibre, is strictly
prohibited and will terminate the license granted herein.


AVAILABILITY AND ACCESSIBILITY OF THE PLATFORM


• EdCalibre strives to ensure that our Services, including our website
https://edcalibre.com/ and mobile application, are available and accessible at all
times. However, we do not guarantee that the Services will always be available or
uninterrupted. Access to the Services may be temporarily suspended without
notice in the case of system failure, maintenance, repair, or for reasons beyond
our control.


• We may need to perform scheduled maintenance on the platform, which may
require taking the Services offline for a period of time. We will make reasonable
efforts to notify Users in advance of any scheduled maintenance that may affect
the availability of the Services. However, there may be instances where we need
to perform emergency maintenance without prior notice.


• We are not liable for any interruptions to the Services that may occur, including
but not limited to:


• Server downtime, coding glitches, hardware failure, software corruption,
human error, malware attacks, or other technical issues.
• Power outages, internet service provider disruptions, or other external
factors that may affect access to the Services.
• Events beyond our reasonable control, such as natural disasters, acts of
terrorism, war, riots, civil disturbances, governmental actions, or other
force majeure events.


• Users are responsible for ensuring that they have the necessary hardware,
software, and internet connection to access and use the Services. We are not
responsible for any limitations, disruptions, or issues related to the User’s
equipment or internet service provider.


• Access to the Services may be limited or restricted based on geographical
location, legal constraints, or other factors. We make no representation that the
Services are available or appropriate for use in all locations. Users accessing the
Services from locations outside India do so at their own risk and are responsible
for compliance with local laws and regulations.


• We reserve the right to modify, update, or discontinue the Services, or any part
thereof, at any time without prior notice. We are not liable to you or any third
party for any modification, suspension, or discontinuation of the Services.


• We welcome feedback from our users to improve the availability and accessibility
of our Services. If you experience any issues or have suggestions for
improvement, please contact our support team at info@edcalibremath.com.

• While using our Services, you may interact with third-party services, websites,
content, or resources that are not owned or controlled by EdCalibre. These

advertisements, promotions, or content provided by other users. EdCalibre does
not endorse or assume any responsibility for any third-party sites, information,
materials, products, or services.


• Our Services may contain links to third-party websites and services. These links
are provided for your convenience only. When you click on a third-party link, you
will be directed to that third party’s site. We have no control over, and assume no
responsibility for, the content, privacy policies, or practices of any third-party
websites or services. You acknowledge and agree that EdCalibre shall not be
responsible or liable, directly or indirectly, for any damage or loss caused or
alleged to be caused by or in connection with the use of or reliance on any such
third-party content, goods, or services available on or through any such website
or service.


• EdCalibre may display advertisements and promotions from third parties on our
Services. Your dealings or correspondence with, or participation in promotions of,
advertisers other than EdCalibre, and any terms, conditions, warranties, or
representations associated with such dealings, are solely between you and such
third party. EdCalibre is not responsible or liable for any loss or damage of any
sort incurred as the result of any such dealings or as the result of the presence of
third-party advertisers on the Services.


• Our Services may include content provided by third parties. All statements or
opinions expressed in such content, other than the content provided by
EdCalibre, are solely the opinions and the responsibility of the person or entity
providing those materials. Such content does not necessarily reflect the opinion
of EdCalibre. We are not responsible, or liable to you or any third party, for the
content or accuracy of any materials provided by any third parties.


• If you decide to access any third-party websites or services linked to our
Services, you do so entirely at your own risk and subject to the terms and
conditions of use for such websites or services. You should review the applicable
terms and policies, including privacy and data gathering practices, of any
third-party websites or services you navigate to from our Services.


• You agree to indemnify, defend, and hold harmless EdCalibre from and against
any and all claims, liabilities, damages, losses, costs, expenses, or fees
(including reasonable attorneys’ fees) arising from or related to your use of any
third-party websites or services, or your interactions with third-party services,
advertisements, or content through our Services.


• The inclusion of any third-party links, advertisements, or content on our Services
does not imply endorsement by EdCalibre of any third-party website, product,
service, or information.


• LIMITATION OF LIABILITY


• To the maximum extent permitted by applicable law, EdCalibre provides the
Services on an “as is” and “as available” basis, without any warranties of any
kind, whether express, implied, statutory, or otherwise. EdCalibre specifically
disclaims any implied warranties of merchantability, fitness for a particular
purpose, non-infringement, and any warranties arising out of course of dealing or
usage of trade.


• EdCalibre does not warrant that the Services will be uninterrupted, timely, secure,
or error-free, or that any defects or errors in the Services will be corrected. We do
not warrant that the information provided through the Services is accurate,
complete, or useful.


• You acknowledge that you are responsible for any actions you take based on the
information and services provided through EdCalibre. We are not liable for any
decisions made or actions taken by you or anyone else based on the information
and services provided through EdCalibre.


• To the maximum extent permitted by applicable law, EdCalibre shall not be liable
for any indirect, incidental, special, consequential, or punitive damages, or any
loss of profits or revenues, whether incurred directly or indirectly, or any loss of
data, use, goodwill, or other intangible losses, resulting from:
• Your use or inability to use the Services.
• Any unauthorized access to or use of our servers and/or any personal
information stored therein.
• Any interruption or cessation of transmission to or from the Services.
• Any bugs, viruses, trojan horses, or the like that may be transmitted to or
through our Services by any third party.
• Any errors or omissions in any content or for any loss or damage incurred
as a result of the use of any content posted, emailed, transmitted, or
otherwise made available through the Services.


• In no event shall EdCalibre’s aggregate liability for all claims relating to the
Services exceed the amount paid by the User, if any, for accessing the Services
during the twelve (12) months immediately preceding the date of the claim.


• Some jurisdictions do not allow the exclusion of certain warranties or the
limitation or exclusion of liability for incidental or consequential damages.
Accordingly, some of the above limitations and disclaimers may not apply to you.
To the extent that EdCalibre may not, as a matter of applicable law, disclaim any
warranty or limit its liabilities, the scope and duration of such warranty and the
extent of EdCalibre’s liability shall be the minimum permitted under such
applicable law.


• You agree to indemnify, defend, and hold harmless EdCalibre, its affiliates,
officers, directors, employees, agents, and licensors from and against any and all
claims, liabilities, damages, losses, costs, expenses, or fees (including
reasonable attorneys’ fees) arising from or related to:


• Your violation of these Terms and Conditions.
• Your use or misuse of the Services.
• Your violation of any rights of another.


• If you believe you have a claim against EdCalibre arising out of or related to your
use of the Services, you must notify us at info@edcalibremath.com within thirty
(30) days of the occurrence of the event giving rise to the claim. Failure to
provide such notice within this period shall result in the waiver of the claim.


TERMINATION


• EdCalibre reserves the right to terminate or suspend your account and access to
our Services at any time, with or without notice, for conduct that we believe
violates this Agreement, is harmful to other Users of the Services, us, or third
parties, or for any other reason in our sole discretion.


• Your account and access to our Services may be terminated or suspended for
reasons including, but not limited to:


• Breaching any terms and conditions of this Agreement or any other
policies or guidelines set forth by EdCalibre.
• Engaging in illegal or unauthorized activities while using our Services.
• Fraudulent, abusive, or inappropriate use of the Services, including
unauthorized sharing of account credentials.
• Failure to pay any fees or charges due for the use of our Services.
• If we suspect that your account has been compromised or used in an
unauthorized manner.


• Upon termination of your account:


• Your right to access and use the Services will immediately cease.
• We may delete or deactivate your account and all related information and
files in your account. We are not obligated to provide you with access to
your account or any data associated with your account after termination.
• You remain responsible for any outstanding payments due prior to
termination. Any fees paid for the Services are non-refundable, except as
provided in our Refund Policy.


• You may terminate your account at any time by contacting our support team at
info@edcalibremath.com. Upon your request for termination:


• Your account will be terminated at the end of the current subscription
period, and you will continue to have access to the Services until that
time.
• No refunds will be issued for the remaining period of your subscription,
except as provided in our Refund Policy.


• If your account has been terminated or suspended and you believe this was done
in error, you may contact our support team at info@edcalibremath.com to request
reinstatement. Reinstatement of the account will be at our sole discretion and
may require additional verification and compliance with our terms and policies.


• All provisions of this Agreement which by their nature should survive termination
shall survive termination, including, without limitation, ownership provisions,
warranty disclaimers, indemnity, and limitations of liability.


• If we terminate or suspend your account, we will endeavor to notify you via the
email address associated with your account. However, we reserve the right to
terminate or suspend your account without prior notice or liability.


GOVERNING LAW


• This Agreement, including its interpretation, construction, and enforcement, and
any disputes arising out of or in connection with it, shall be governed by and
construed in accordance with the laws of India, without regard to its conflict of law
principles.


• You agree to submit to the exclusive jurisdiction of the courts located in
Ahmedabad, Gujarat, India, for the resolution of any disputes arising out of or
relating to this Agreement or your use of our Services.


• Any legal action or proceeding arising under this Agreement will be brought
exclusively in the courts located in Ahmedabad, Gujarat, India. You and
EdCalibre agree to submit to the personal jurisdiction of these courts and waive
any jurisdictional, venue, or inconvenient forum objections to such courts.


• You agree to comply with all applicable local, state, national, and international
laws and regulations in connection with your use of the Services. You are
responsible for ensuring that your use of the Services is compliant with any
applicable laws, regulations, and ordinances.


SEVERABILITY


• If any provision of this Agreement is found to be invalid or unenforceable by a
court of competent jurisdiction, such provision shall be severed from the
Agreement, and the remaining provisions shall remain in full force and effect.


ENTIRE AGREEMENT


• This Agreement constitutes the entire agreement between you and EdCalibre
regarding the use of our Services and supersedes any prior agreements or
understandings, whether written or oral, between you and EdCalibre.

and the nature of the request.


• We value your feedback and suggestions to help us improve our Services. If you
have any feedback or suggestions, please do not hesitate to share them with us

enhance the overall user experience.
